This Privacy Policy explains how Split Mix Holdings LLC, a Michigan limited liability company ("Split Mix," "we," "us"), handles information in connection with the SplitJam desktop application ("SplitJam," the "App") and the SplitJam website. For purposes of applicable data protection law, Split Mix is the controller of the limited information described below.
SplitJam is currently designed to run on your Mac and to minimize the information that leaves your device. This policy describes how the App and website work today. We may change the App, its features, and our data practices over time (for example, we may introduce optional or required accounts, cloud features, or additional diagnostics); when we make material changes we will update this policy and its version, and, where the law or the change requires it, ask you to review or agree to the update. The capitalized terms used here have the meanings given in our Terms of Service.
1. Your audio is processed on your Mac
In the current version, SplitJam performs splitting, mixing, and recording locally on your computer. The songs you load, the stems the App creates, your recordings, and your exports are written to your Mac. In normal operation the App does not upload your audio files to us, and we do not receive or store your audio. The App does download software updates and supporting files (such as separation models) from us or our providers, which does not involve sending your audio. If we later add any feature that would transmit your audio or files, we will update this policy first and, where required, obtain your consent.
2. Accounts and your local profile
The current version of SplitJam does not require you to create an account or sign in to use the App, and we do not ask for your name or email address to run it. You may optionally set a local profile (such as your instrument, player type, or experience level) and preferences; these are stored on your Mac and are used by the App, including to decide which in-app messages and announcements are relevant to you. That selection is performed on your device.
However, if you enable optional analytics or diagnostics (see Section 3), non-identifying, profile-derived facets (such as player type, experience level, edition, region, or language) may be transmitted to us in anonymized, aggregated form along with a random, non-identifying installation identifier. We may also introduce optional or required accounts or cloud features in the future. Accordingly, you should not assume that profile or usage information will remain only on your device in all circumstances; this policy describes what is transmitted and when, and we will update it if our practices change.
3. Information involved, and why
SplitJam is designed to minimize data. The information that may be involved includes:
- Update check. The App may check whether a newer version is available. This request necessarily involves your device's IP address at the network level (as any internet request does) but is not designed to send your account, your local profile, or your audio.
- Announcements / messages. The App may download a messages file to display product announcements, updates, and offers. In the current version this is a one-way download, and the decision about which messages are relevant to you is made on your device using your local profile; that selection does not, by itself, send your profile to us.
- Analytics and surveys (usage sharing). SplitJam includes a "share anonymous usage data" setting. In the current version this setting is on by default; it is disclosed when you first set up the App (where you can decline it), and you can turn it off at any time in the App's settings. While it is on, the App may send anonymous usage events to help us understand how SplitJam is used and to improve it. These events are tied to a random, non-identifying installation identifier and are limited by design to a defined set of event types and non-identifying facets. Those facets may include profile-derived, segment-level information such as your player type, experience level, edition, region, and language, which lets us understand and segment our audience in aggregate. They are designed to exclude your name, email, precise location, your audio, and free-text entries. Separately, if you choose to submit an in-app survey, your answers are sent with the same random installation identifier.
- License activation and check-in (Unlimited and add-ons). If you purchase Unlimited (or an add-on), activating your license sends your License Key and an irreversible hashed device identifier to our activation service to confirm the purchase and bind the key to your device (to limit casual key sharing). After activation, the App checks in with the same service once each time you start it, if your device is online, so that a license that has been refunded or revoked can be recognized. This check sends your License Key, the hashed device identifier, and the App version, and nothing else. It contains no account and no personal profile, and, like any internet request, involves your device's IP address at the network level. If you are offline or the check fails, the App keeps working normally; the App does not otherwise phone home and does not run continuously in the background. [ATTORNEY/OWNER] confirm wording and the retention period for activation records.
- Support and feedback. If you contact us or submit feedback, you choose what to send (for example, by email). We use that information only to respond to and address your request.
- Website. Our website may collect standard server logs and, if enabled, privacy-respecting analytics and a waitlist email you choose to provide. See Section 7. [ATTORNEY/OWNER] finalize which website analytics/waitlist tools are used.
4. Current practices
In the current version of SplitJam, and subject to the rest of this policy:
- we do not sell or rent personal information;
- in normal operation the App does not upload your audio files, and we do not receive or store your audio;
- we do not use your audio to train models;
- the App does not require you to create an account to use it, and the analytics described in Section 3 are designed to use a random installation identifier rather than your name or email and to exclude free-text and precise-location data.
These statements describe how the App works today and are not permanent commitments. We may change the App and these practices in the future (including by introducing accounts, cloud features, or additional data processing), and this policy will be updated to reflect any such change.
5. Legal bases (where applicable, e.g. EEA/UK)
Where data protection law requires a legal basis, we rely on the performance of a contract (to activate and provide Unlimited), our legitimate interests (to secure the App, check for updates, deliver in-app announcements, and respond to support requests), and, where applicable, your consent. [ATTORNEY] The usage-sharing setting is currently on by default (opt-out) with a first-run disclosure. In jurisdictions that require prior, affirmative opt-in consent for this kind of analytics (for example the EEA/UK), confirm whether the setting must default off and be presented as an explicit opt-in there, and align the legal basis accordingly, before relying on consent as the basis.
6. How we use information
We use the limited information described above to: provide and secure SplitJam; verify and activate Unlimited licenses; deliver updates and announcements you can act on; understand and improve the product in aggregate; and respond to your support or feedback requests. We do not use this information to serve you third-party advertising or to build advertising profiles about you. As described in Sections 2 and 3, we do use limited, non-identifying information to decide which in-app messages are relevant and to understand our audience in aggregate.
7. Cookies, local storage, and website analytics
The App stores your settings and acceptance records in your Mac's local storage on your device; these are not cookies sent to us. Our website may use strictly necessary cookies and, if enabled and permitted, privacy-respecting analytics to understand site traffic. Where required, we will request consent for non-essential cookies/analytics. [ATTORNEY/OWNER] finalize the website cookie/analytics disclosures to match the tools actually deployed.
8. Service providers and international transfers
We rely on a small number of third parties to operate: our merchant of record (payment processing for Unlimited), and cloud infrastructure / content delivery for the website, update check, messages file, and activation service. These providers process information on our behalf or as independent controllers under their own policies, and may process data in the United States or other countries. Where required, we use appropriate safeguards for international transfers. [ATTORNEY/OWNER] list the named providers (e.g. the MoR, AWS) once finalized.
9. Payments
Purchases of Unlimited are processed by our payment provider acting as the merchant of record. They handle your payment details under their own privacy policy; we do not receive or store your full payment card information.
10. Data retention
Because the current version of the App stores your library, profile, and settings on your device, most data stays under your control and is removed when you delete it or uninstall the App. For the limited server-side records we do hold (for example, license activation records and any usage analytics), we keep them only as long as needed for the purposes above or as required by law, then delete or anonymize them. [ATTORNEY] set specific retention periods.
11. Security
We use reasonable technical and organizational measures to protect the limited information we handle, including signing the messages file and using an irreversible device hash for activation. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.
12. Your rights and choices
Depending on where you live, you may have rights to access, correct, delete, or port personal information, to object to or restrict certain processing, and to withdraw consent. Because the current version of SplitJam does not require an account and does not collect your name or email, the limited data we hold is generally not linked to your identity, and in many cases we may be unable to connect a request to specific records (for example, anonymized analytics are keyed only to a random installation identifier). Where we are able to act on a request, we will. You can:
- turn the usage-sharing (analytics/surveys) setting on or off at any time in the App's settings;
- delete your local SplitJam data by removing it in the App or uninstalling;
- contact us at support@splitjam.music to exercise an applicable right.
We will not discriminate against you for exercising these rights.
13. Do Not Track and Global Privacy Control
Our website honors recognized opt-out signals such as Global Privacy Control (GPC) where required by law. Because industry standards for "Do Not Track" are not uniform, we treat GPC as the applicable signal. [ATTORNEY] confirm per jurisdiction.
14. Children's privacy
SplitJam is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child provided us personal information, contact us and we will delete it.
15. Regional disclosures
United States (California and similar states). We do not sell or "share" (for cross-context behavioral advertising) personal information. You may exercise applicable rights as described in Section 12. [ATTORNEY] add the specific CCPA/CPRA categories and notices if we fall in scope.
EEA / UK. Split Mix is the controller; legal bases are in Section 5; you may lodge a complaint with your local supervisory authority. [ATTORNEY/OWNER] an EU/UK representative may be required depending on volume and targeting.
16. Data breach
If a security incident affecting personal information occurs, we will investigate and provide any notifications required by applicable law within the required timeframes.
17. Changes to this policy
We may update this policy. When we make material changes, we will revise the version and date above, and the App will ask you to review and agree to the update before you continue using it.
